What Legal Options Does a Family Have After a Fatal Bicycle Crash in Garland, TX?

When a cyclist is killed while crossing a street in Garland, surviving family members may be able to pursue a wrongful death claim under Texas law. In cases where the driver remains at the scene and cooperates with investigators, that cooperation can also help establish an initial framework for understanding how the crash occurred, although it does not determine legal responsibility on its own.

From a legal standpoint, eligible surviving family members in Texas, such as spouses, children, and parents, may file a wrongful death claim when a death results from another person’s negligence. As the case develops, liability will depend heavily on the specific actions of the driver, including whether they were speeding, distracted, or failed to notice the cyclist in time to avoid impact.

At the same time, crashes involving cyclists crossing roadways often require a closer examination of how right of way applied at the moment of the collision. Questions about visibility, road design, and whether either party had a duty to yield become central to understanding how the incident unfolded.

In addition, Texas law requires drivers to exercise reasonable care to avoid striking cyclists and pedestrians, even when they are not in a marked crosswalk. However, how fault is assigned can still vary significantly based on the exact location and circumstances of the crossing.

Because of these issues, gathering evidence becomes an important step in clarifying what happened. Details such as the crossing point, traffic signals or signage in the area, roadway conditions, and witness statements from the moments before the crash can all help build a clearer picture of the event.

Texas also follows a modified comparative fault system, which means compensation may be reduced if the cyclist is found to share some responsibility for the crash. However, recovery may still be available as long as the cyclist is not found to be more than 50 percent at fault.

Finally, the damages available in a wrongful death claim may include funeral and burial expenses, lost future income, and the loss of companionship and emotional support. Legal guidance can help families gather evidence, respond to comparative fault arguments, and ensure that any resolution reflects the full impact of their loss.
